Guidance from a New York City citizenship and immigration lawyer
Many of those seeking to become U.S. citizens run into problems. As a full-service immigration law firm in NYC, we have helped clients through numerous challenges—some expected and some surprising. Here we present some of the common problems immigrants face while seeking New York City immigration or naturalization.
Problems with the citizenship test
In New York City naturalization eligibility interviewing, a U.S. Citizenship and Immigration Service (USCIS) officer will test your ability to read, write, and speak English. You will also be given a civics test in English to assess your knowledge and understanding of U.S. history and government. If you fail either test portion of the interview, you are allowed another try. Your second interview takes place about three months after the first one, giving you time to study and prepare.
If you fail the second testing, Immigration denies your citizenship. You may reapply, which means you must once again pay the notoriously high fees. To make sure that you are ready for the test, see the USCIS Study Materials for the Naturalization Test webpage.
Problems with the “good moral character” clause
Claims of good moral character are evaluated on a case-by-case basis against standards of the average citizen in the community. If you are denied citizenship in NY based on this clause, or believe that something in your history may cause you to be denied, contact a New York City immigration law firm who can help you determine your options.
